Under a bill being considered by the New York City Council, employers would be required to inform job applicants if and how they are using artificial intelligence (AI) technology to inform their hiring decisions. Additionally, AI technology vendors would reportedly have to provide bias audits of their products before selling them and offer to perform ongoing audits after purchase.
The bill would require any employers utilising these tools to notify each candidate, within 30 days of screening, about the specific product that was used to evaluate them, as well as the qualifications or characteristics considered by any algorithms used. The bill will come into effect on January 1, 2022, if it passes. SHRM looks more closely at the bill and the increasing use of AI as an HR tool.
