[Montenegro] Obligatory severance payments and longer annual leave for disabled workers

In Montenegro, a proposal for a draft labour law to introduce increased protections for people with disabilities and parents of children with disabilities has progressed through parliament, CDM reports.

Under the proposed amendments, employers would be required to reassign disabled workers to a position that corresponds to their qualifications and capabilities, based on an assessment by a competent body. 

Where that is not possible, disabled employees will reportedly be granted other rights in line with the law and the service-level agreement.

If no alternative solutions for an employee with additional needs are available, an employer may determine that it is no longer possible to retain them. In such cases, the disabled worker would be entitled to a severance payment. 

The amendments also stipulate that disabled employees cannot be transferred to a role outside their place of residence without their consent. They will also be entitled to annual leave of a minimum of 26 working days.
